
Online Donation Terms & Conditions
These Online Donation Terms and Conditions govern donations made to The Museum and Art Gallery of the Northern Territory (MAGNT) via its website and other digital donation channels. By making a donation through our digital platforms, the donor ("you") acknowledges and agrees to be bound by these terms.
1. About MAGNT
MAGNT is a not-for-profit organisation established to collect, protect and share the Northern Territory's past, present and future. We connect people to the stories of the Northern Territory. Our collection drives curiosity, exploration and partnerships. Our physical spaces are destinations loved by locals and a must-see for Territory visitors. Our digital connectivity expands the reach of our collection. Our guests tell their friends about their distinctive Territorian experience.
Donations received by MAGNT are applied towards the growth of specified exhibitions, collections, research, and public programs in our venues across the Northern Territory, subject to donor directions.
2. Donations
Donations may be made through MAGNT’s website using the payment methods made available.
By submitting a donation, you confirm that:

the information you provide is true and correct;

you are authorised to use the payment method selected; and
-
you understand that your donation will be processed in accordance with these terms.
3. Classification of Donations
Donations made through MAGNT’s website will be treated as Designated Donations, as described below.
3.1 Designated Donations
Donations are made strictly to identified projects, appeals, programs, activities or other stated purposes offered by MAGNT through its website. These donations will be treated as Designated Donations and the funds applied directly to the nominated purpose.
Where a donation has been made via direct bank transfer, the donor is required to designate, via email or telephone, the identified project, appeal, program, activity or other stated purpose to which the donation will be applied. If no designation has been made within two (2) weeks of receipt of the donation, MAGNT reserves the right to designate a project, appeal, program, activity or other stated purpose at its discretion.
4. Donor Direction
The donor’s selection at the time of donation, together with these Terms and Conditions and any specific wording published on the relevant donation page, will form the basis on which MAGNT classifies, administers and stewards the donation.
Donors are responsible for ensuring that the purpose selected at the time of donation reflects their intended direction.
5. Circumstances Affecting Designated Donations
MAGNT will use reasonable endeavours to apply Designated Donations in accordance with the donor’s nominated purpose.
If MAGNT determines, acting reasonably, that the nominated purpose:
a. has been fully funded;
b. cannot be carried out as described;
c. is no longer feasible or appropriate to pursue; or
d. will be subject to a significant delay or a material change in scope,
then MAGNT will, where practicable, contact the donor using the contact details provided by the donor and seek the donor’s direction regarding the application of the donation to one or more alternative purposes offered by MAGNT that are as consistent as reasonably possible with the donor’s original intention.
Pending receipt of that direction, MAGNT will retain the donation for the nominated purpose and will not apply it to another purpose without the donor’s consent.
If, after taking reasonable steps, MAGNT is unable to contact the donor or obtain further direction within a reasonable period, MAGNT may deal with the donation in accordance with applicable law, relevant regulatory requirements and MAGNT’s internal policies relating to donor funds.
6. No Change-of-Mind Refunds
Except as set out in Section 7, donations are irrevocable and non-refundable, including where a donor changes their mind after making a donation.
7. Payment Errors and Unauthorised Transactions
MAGNT may, acting reasonably, provide a refund or reversal where:
-
donation was processed in error;
-
a duplicate transaction occurred;
-
an incorrect amount was debited due to a processing error; or
-
the donor demonstrates that the transaction was unauthorised or fraudulent.
Any request under this clause must be made as soon as reasonably practicable after the transaction and should be directed to development@magnt.net.au. MAGNT may require evidence reasonably necessary to investigate the request before determining whether a refund or reversal will be made.
8. Tax Deductibility
MAGNT is endorsed by the Australian Taxation Office (ATO) as a Deductible Gift Recipient (DGR). Donations of $2 or more may be tax-deductible in Australia, subject to applicable law and the donor’s personal taxation circumstances.
A compliant tax receipt will be issued for eligible donations using the details provided by the donor upon the successful deposit of funds.
9. Recurring Donations
Where MAGNT offers recurring donation functionality and a donor elects to make recurring donations:
-
the donor authorises MAGNT to debit the nominated payment method at the selected frequency and amount;
-
recurring donations will continue unless cancelled by the donor or discontinued by MAGNT; and
-
the donor may request cancellation or amendment of the recurring donation arrangement by contacting MAGNT using the contact details published on its website.
MAGNT may require reasonable notice to process any change to a recurring donation arrangement.
10. Receipts and Communications
By donating, the donor agrees that MAGNT may issue receipts, confirmations and communications relating to the donation electronically, including by email.
MAGNT may also contact donors in relation to the administration of their donation, including where further information or instructions are required in connection with a Designated Donation.
11. Privacy
Any personal information collected in connection with a donation will be handled in accordance with applicable privacy laws, including the Privacy Act 1988 (Cth), and MAGNT’s Privacy Statement.
12. Amendments
MAGNT may amend these Terms and Conditions from time to time by publishing an updated version on its website. The terms in effect at the time a donation is made will apply to that donation.
